The theme of this work is an institute of expropriation in the Croatian legal system. Institute of expropriation is one of the institutes which state coercion governing rem relations to property rights holders when the objective is the realization of common interests. Expropriation in the Republic of Croatia is regulated by the Law on Expropriation and determining compensation as a general law that is used in all expropriation proceedings. However, the expropriation procedure is regulated by a series of other laws, some more, some less, deviate from the general law. In Croatia, the expropriation long been present, but due to different historical and political circumstances changed over more national legal organization. Shown that in certain cases, departure from the general regulation of expropriation is necessary and justified. However, as it will be shown that certain deviations from the general regulation of expropriation contrary to the Croatian Constitution and that because of these discrepancies, the protection of human rights in the procedures which are carried out according to some laws is not always assured. This work will show that at the institute of expropriation, which is carried out solely in the public interest, in fact a conflict between individual rights and public interest in which the public interest is more important. For the purpose of this work, analized is subject of the jurisdiction of the State Administration Office in Požega – Slavonia Country.
