Abstract
završnom radu je prikazana tema ništetnosti pravih poslova. Definirana je ništetnost kao jedan od oblika nevaljanih pravnih poslova. Uz pobojnost, ništetnost predstavlja oblik nevaljanih pravnih poslova. Analizirani su razlozi koji dovode do ništetnosti, odnosno: poslovna nesposobnost strana, nevaljanost i nesuglasnost očitovanja volje, nemogućnost činidbe, nedopuštenost činidbe, neodređenost ili neodredivost činidbe, nedopuštenost pobuda za sklapanje pravnog posla, nedostatak potrebnog... More oblika. Također je analizirana djelomična ništetnost te posljedice ništetnosti. Prikazano je tko može isticati zahtjev za ništetnost ugovora i u kojem roku. Iako načelno ništetni poslovi ne mogu konvalidirati, Zakon o obveznim odnosima u nekim slučajevima dopušta njihovu konvalidaciju. Konverzija je pretvaranje ništetnog pravnog posla u valjani pravni posao, a Zakon predviđa konverziju. Less
Abstract (english)
This final paper presents the theme Nullity Legal Affairs. Nullity as a form of invalid legal transactions is defined.With voidance, it represents a form of invalid legal acts. The reasons that lead to the nullity are analyzed, namely: the incapacity of the parties, the invalidity and inconsistency of declarations of intent, lack of commitment, inadmissibility of commitment, vagueness orindeterminacy of commitment, inadmissibility of the motive for concluding a legal act, the lack of... More the necessary forms. It also analyzes the partial invalidity, and the consequences of nullity. Who can stand the application for nullity of contractandin what time frame is defined. Although in principle invalid jobs can not be validated, Obligations Act allows their validation in some cases.
