Abstract
Prema Obiteljskom zakonu, imovinski odnosi bračnih drugova uređuju se zakonskim ili ugovornim sustavom. Temeljna načela za uređenje imovinskih odnosa su: ravnopravnost, obiteljska solidarnost, autonomija volje i zaštita prava trećih osoba. Dvije su vrste imovine bračnih drugova, bračna stečevina i vlastita imovina. Bračna stečevina je imovina koju su bračni drugovi stekli radom tijekom trajanja bračne zajednice ili imovina koja potječe iz te imovine. Vlastita imovina je imovina koju bračni drug... More već posjeduje u trenutku sklapanja braka. Bračnim ugovorom supružnici uređuju imovinskopravne odnose na postojećoj i budućoj imovini. Sklapa se u pisanom obliku i potpisuju ga bračni drugovi čije potpise ovjerava javni bilježnik, a može se sklopiti prije sklapanja braka ili tijekom trajanja braka. Zakonom nije određen predmet bračnog ugovora, pa se ništetnim smatra svaki ugovor koji je protivan Ustavu Republike Hrvatske, prisilnim propisima i moralu društva. Radi zaštite trećih osoba u nekim zemljama uveden je registar bračnih ugovora, u Republici Hrvatskoj to još nije uspostavljeno, ali se zaštita očituje na upisu suvlasništva u zemljišne knjige, odnosno javne upisnike, ovisno o vrsti imovine. Abstract (english)
According to the Family Act, property relations of spouses are regulated by legal or contractual system. The basic principles for the regulation of property relations: equality, family solidarity, party autonomy and protection of the rights of third parties. There are two kinds of property of spouses, marital property and personal property. Matrimonial property is property which the spouses acquired by their work for the duration of marriage or assets from that property. Individual property is... Shall be concluded in writing and signed by both spouses whose signatures certified by a notary public, and may be concluded before marriage or during marriage. The law is not determined by the subject of the marriage contract, and is considered a nullity any contract that is contrary to the Croatian Constitution, peremptory norms and morals. In order to protect third parties in some countries introduced a register of marriage contracts, in Croatia it has not been established, but the protection is reflected in the registration of ownership in the land registry or public registers, depending on the type of property.
