Abstract Odvajanje, pravljenje razlike po socijalnim, imovinskim, rasnim, etničkim i drugim osobinama čovjeka jest diskriminacija koja rezultira otežanim ili čak onemogućenim ostvarenjem određenih ljudskih prava. Diskriminacija postoji u različitim oblicima. Najčešći oblici diskriminacije jesu izravna i neizravna diskriminacija te uznemiravanje i spolno uznemiravanje. Uz izravne oblike, koji se obično prikazuju kao „jasna“ diskriminacija, moraju se razlikovati i drugi oblici diskriminacije koje je teže prepoznati, a samim time je i teže boriti se protiv njih. U današnje vrijeme diskriminacija je česta pojava, a posebice u radnom pravu i radnom odnosu. Ovaj završni rad povezan je upravo s tom tematikom te prikazuje pojmovno određenje i vrste diskriminacije, ali i definira samu diskriminaciju općenito, ali i u radnom pravu. Rad navodi najčešće oblike diskriminacije ne samo u radnom pravu već i općenito, a to su spolna diskriminacija – diskriminacija na temelju spola, dobna diskriminacija – diskriminacija na temelju životne dobi te diskriminacija na temelju spolne orijentacije. Nadalje, u radu se nalazi i prikaz antidiskriminacijske regulative u Republici Hrvatskoj gdje su prikazani svi pravni propisi koji štite od same diskriminacije. Naime, u tom dijelu rada prikazan je i okvir Europske unije. Prikazat će se i nekoliko slučajeva europske i hrvatske sudske prakse te presuda koje su donesene na temelju pravno iznesenih činjenica.
Abstract (english) Separation, making a difference according to social, property, racial, ethnic and other characteristics of a person is discrimination that results in difficult or even impossible realization of certain human rights. Discrimination exists in various forms. The most common forms of discrimination are direct and indirect discrimination, as well as harassment and sexual harassment. In addition to direct forms, which are usually portrayed as "clear" discrimination, there must be a distinction between other forms of discrimination that are more difficult to identify and therefore more difficult to combat. Nowadays, discrimination is a common occurrence, especially in labor law and employment. This final paper is related to this topic and shows the concept and types of discrimination, but also defines discrimination in general, but also in labor law. The paper lists the most common forms of discrimination not only in labor law but also in general, namely gender discrimination - discrimination based on sex, age discrimination - discrimination based on age and discrimination based on sexual orientation. Furthermore, the paper presents an overview of anti-discrimination regulations in the Republic of Croatia, which presents all legal regulations that protect against discrimination. Namely, in this part of the paper, the framework of the European Union is presented. Several cases of European and Croatian case law and judgments based on legally stated facts will also be presented.
