Abstract
Imovinski odnosi bračnih drugova mogu se urediti sporazumno ili sudskom odlukom. Bračni drugovi s zajedničkom maloljetnom djecom dužni su prije pokretanja postupka razvoda braka na sudu sudjelovati u postupku posredovanja, koji se provodi u centru za socijalnu skrb. Svrha provođenja postupka posredovanja je zaštita prava i interesa maloljetne djece. Roditeljima i drugim osobama kojima je djelomice ili u cijelosti povjereno pravo na ostvarivanje skrbi o djetetu određuju se mjere za zaštitu prava... More i dobrobiti djeteta, a određuju se na temelju stručne procjene ako se utvrdi da je došlo do povrede djetetovih prava i dobrobiti ili da su prava i dobrobit te razvoj djeteta ugroženi. Dijete ima pravnu sposobnost, no unatoč tome, ono nije sposobno samo sudjelovati u pravnom prometu. Razlog tome je nedostatak poslovne sposobnosti. Stoga, radi zaštite prava i interesa djeteta, u ime djeteta i za njegov račun njegovi roditelji zaključuju pravne poslove. Obvezu zastupanja vrše roditelji, koji također vrše i ostale dužnosti. Roditelji spomenutu obvezu vrše zajedno i ravnopravno. U slučaju kada u ime i za račun djeteta istupa samo jedan roditelj postoji prešutna suglasnost drugog roditelja za to zastupanje, osim ako se taj roditelj ne usprotivi. Dijete samo raspolaže imovinom koju je steklo radom, a prava roditelja te njihove dužnosti prema imovini djeteta su: upravljanje imovinom djeteta, korištenje prihoda s imovine i raspolaganje imovinom. Property relations of spouses may be regulated by agreement or court order. Spouses with common minor children are required before initiating divorce proceedings in court to participate in the mediation process, which is carried out in a social welfare center. The purpose of the mediation procedure is to protect the rights and interests of minor children. Parents and others who are partly or entirely entrusted to the realization of the right to care for the child are determined by measures to...
