Abstract
Tema završnog rada je uloga javnog bilježnika u ostavinskom postupku. Kako bi se definirala uloga javnog bilježnika u ostavinskom postupku najprije će se definirati što je to ostavinski postupak u Hrvatskom pravu. Objasnit će se pojmovi vezani uz sam postupak kao što su oporuka, načela i nadležnost u ostavinskom postupku. Nakon toga slijedi definiranje javnog bilježnika, koja je njegova dužnost kao povjerenika javnog suda i na koji način dolazi na funkciju te kako može biti razriješen iste. Za poslove koje obavlja javni bilježnik može biti nagrađen ili dobiti dodatne naknade. Na kraju završnog rada objasnit će se što je to Europska potvrda o nasljeđivanju i koja je njezina svrha u europskom pravu.
Abstract (english)
The theme of this paper is the role of the public notary in the inheritance procedure. In order to define the role of the public notary in the inheritance procedure, the inheritance procedure in Croatian law will be defined first. The concepts related to the procedure itself will be explained, such as the will, principles and jurisdiction in the inheritance procedure. The proceeding of the inheritance procedure is carried out under the provisions of the Inheritance law. Further follows the definition of a public notary, which is his duty as a public court commissioner, how does he come to function and how the function of the notary can be released. For jobs performed by a public notary, she or he may be rewarded or recive additional offers. At the end of this dissertation it will be explained what is the European confirmation of inheritance and its purpose in European law.
