Abstract
Tema ovoga završnoga rada je „Odgovornost za štetu bez krivnje“, koju pravna teorija naziva i objektivna odgovornost. Cilj ovog rada je definirati odgovornost za štetu bez krivnje, te postaviti analizu kroz primjere. U prvom dijelu rada obrađen je pojam odgovornosti za štetu te koje su njene vrste, navodi se koje su pretpostavke odgovornosti za štetu. Nadalje se definira štetnik i oštećenik, kao subjekti odnosa odgovornosti za štetu. Zatim se prikazuje i obrazlaže pojam krivnje uz koje se analiziraju i pojmovi uzročnosti, protupravnosti, štetne radnje te štete. Na kraju rada se definira pojam odgovornosti za štetu bez krivnje odnosno objektivne odgovornosti te se navodi u kojima se oblicima odgovornost za štetu pojavljuje. Konačno analizirana je odgovornost za štetu kroz primjere iz sudske prakse.
Abstract (english)
The theme of this final paper is "Liability for damages without guilt“, which is called objective liability by the legal theory. The aim of this paper is to define liability for damages without guilt, and set the analysis through examples. In the first part of the paper, the concept of liability for damages and how it can be divided is explained and the assumptions of liability for damages will be identified. Furthermore, the perpetrator and the injured party will be defined as the responsibility liability parties. Then, the term guilt will be introduced and explained, with the terms causality, malpractice, harmful acts and damages. At the end of the paper, the concept of liability for damages without guilt or objective liability will be determined and the forms, in which liability for damages occurs, will be explained. Finally, the liability for damages will be analyzed through examples from case law.
