Abstract
Predmet ovog završnog rada je proučavanje ortakluka u hrvatskom pravnom sustavu koji je analiziran kroz ukupno sedam poglavlja, uključujući uvod i zaključak. Ortakluk je društvo osoba, društvo građanskog prava, tj. zajednica ortaka i sve najvažnije odredbe o njemu sadržane su u Zakonu o obveznim odnosima (NN 35/05, 41/08, 125/11, 78/15, dalje: ZOO), a da je ono doista bitno za trgovačko pravo potvrđuje činjenica da se odredbe o njemu podredno primjenjuju i na društva trgovačkog prava te se stoga u okviru trgovačkog prava i proučava. Upravo zbog posebitosti toga društva glavni je cilj rada predstaviti pojam ortakluka čitatelju od samog nastanka do njegovog prestanka, a posebna je pozornost posvećena pravima i obvezama ortaka koji su u toj zajednici osoba ponukani istim zajedničkim ciljem. Prema korištenim izvorima od kojih su ključni ZOO i literatura na navedenu temu, iznjedrava zaključak kako je ortakluk zaista specifično društvo te je potrebno poticati da više zaživi u praksi.
Abstract (english)
The subject of this final paper is research of partnership in croatian law system which is analyzed trough seven chapters, including introduction and conclusion. Partnership is society person, society of civil rights, namely unity persons and all most important regulation about it are kept in Law on obligations (NN 35/05, 41/08, 125/11, 78/15, next: LOO) and that it is very important for comercial law, we have fact saying us that terms about it subsidiary apply and on society of comercial law so because of that we learn about it. Just because of speciality of the society the main goal of work is to present term of partnership to the reader from the beggining to the end. According to the used resources from which the key one is Civil obligations act and literature on this subject, show us the conclusion of how the partnership is really specific society which we need to push more in practical work.
