Abstract
Radnik pojedinac samo u iznimnim slučajevima ima moć pregovaranja na tržištu rada, te obično prihvaća uvjete koje mu nudi poslodavac. Neusporedivo jača snaga i moć poslodavca može stvoriti prema radnicima neljudske uvjete rada i života. Stoga, u hrvatskom pravnom sustavu postoje kolektivni ugovori i kolektivno pregovaranje, kako bi radnici bili u povoljnijem položaju. Cilj kolektivnog pregovaranja bio je zamjena donošenja odluka od strane poslodavaca kako bi se prevladao slabiji položaj radnika, i samim time osigurali povoljniji uvjeti života i rada radnika. Svrha kolektivnog pregovaranja bila je sklapanje kolektivnih ugovora kojim sindikat postiže povoljnije uvjete rada nego što bi ih sam pojedinac mogao postići, tako je većinom i danas. Kolektivni ugovori u Republici Hrvatskoj su glavna tema ovog rada.
Abstract (english)
The employee has only in exceptional circumstance the power of negotiation on the labor marketand can accept the conditions that the employer is offering. Incomparably the power of the employer can make unhumal working and living conditions to the employees. Therefore, in Croatian legal system exist collective agreements and collective negotiation. The goal of a collective negotiation was to gradually replace decision making from the employer, to he employee to overcome the weaker position of the empoyees and securing better living and working conditions. The goal of collective negotiation was to make collective agreement which the trade union gets better working conditions than an individual can get, as many of the companies use this model. The collective agreements are the theme of this final work.
