Abstract U Franačkoj znači sve pravo koje je vrijedilo na prostoru Franačke bez obzira na njegovo podrijetlo, njegova stvaratelja, tj. to je pravo u prostornom smislu riječi, dok franačko pravo znači samo pravo franačkih plemena, tj. to je pravo u personalnom, etničkom smislu. Franačkoj je vrijedilo načelo personaliteta prava i to etničkog personaliteta; to znači da je svaka etnička skupina, odnosno pleme imala svoje pravo. Što se tiče starosjedilaca u Galiji, za njih je i dalje važilo vulgarno rimsko pravo, jer je to pravo rimska država već nekoliko stoljeća bila nametnula galskom stanovništvu, a njihova plemenska organizacija je uvelike bila nestala. Međutim, franačko pravo je imalo velik utjecaj na prava većine europskih naroda te isto tako i na naše. Osnova franačke države je pleme i vojska. U početku čine istu cjelinu, a tokom 7. i 8. stoljeća nastaje njihova secesija, iako možemo reći da za čitavog trajanja Franačke, pleme ostaje u osnovi poimanja vlasti i vojske. Državno ustrojstvo je obuhvaćalo kralja, narodnu skupštinu, sabor velikaša i vojno-upravnu i sudsku organizaciju. Kod izvora prava naglašavaju se plemenska prava i državni propisi. Kazneno i postupovno pravo Franačke su takva prava koja su potpunosti proizašla iz Salijskog zakona. Obiteljsko pravo je do 8.st. posredno i donekle uređeno plemenskim zakonima, zapravo više je uređeno običajima. Odredbe obiteljskog prava sadržane su u više titula Salijskog zakona. Nasljedno pravo je regulirano običajnim pravom plemena te je sadržajno u Salijskom zakonu i odnosi se u većini slučajeva na pokretnine. Stvarno pravo obuhvaća zaštitu, a obvezno se pravo svodi na držane dane riječi tj. ugovor nastaje davanjem svečane riječi
