Abstract
Radni sporovi su sporovi između radnika i poslodavca u vezi rada radnika za poslodavca. Radni sporovi mogu se podijeliti na individualne i kolektivne radne sporove. Kada je riječ o kolektivnom radnom sporu, tada da je na strani poslodavaca moguće imati organizaciju poslodavaca te kolektivitet radnika (organizaciju radnika) s druge strane. Hrvatsko pravo predviđa, uz zaštitu prava ispred nadležnih sudova, alternativni način zaštite prava iz radnog odnosa. To se postiže kroz mirenje i arbitražu. Ova dva instituta mirnog rješavanja kolektivnih radnih sporova mogu se primijeniti i u individualnim radnim sporovima. Mirenje i arbitraža instituti su novijeg datuma koji su svoje mjesto pronašli i u sporovima u Hrvatskoj. Za to je važna praksa tuzemnih sudova, ali i sudova Europske unije.
Abstract (english)
Labor disputes are disputes between the worker and the employer regarding the work of the worker for the employer. Labor disputes can be divided into individual and collective labor disputes. When it comes to a collective labor dispute, then it is possible to have an employer organization on the side of employers and a collective of workers (an organization of workers) on the other. Croatian law provides, with the protection of rights before competent courts, an alternative way of protecting employment rights. This is achieved through conciliation and arbitration. These two institutes for the amicable settlement of collective labor disputes can also be applied in individual labor disputes. Reconciliation and arbitration are recent institutes that have found their place in disputes in Croatia. This is important for the practice of both domestic and European Union courts.
