Abstract
U ovom radu se teorijski i praktično obrađuje tema Ostavinski postupak. Detaljnije će se analizirati pojam nasljednog prava, obilježja te pretpostavke stjecanja nasljednog prava. Spomenut će se i ostavinski postupak općenito, njegova načela i nadležnost za raspravljanje ostavine. Prethodne radnje ostavinskog postupka bit će navedene i objašnjene kao i samo pokretanje i provođenje ostavinskog postupka. Pri samom kraju rada, bit će spomenuta i objašnjena ostavinska rasprava, njen tijek i provođenje. Usporedit će se ostavinski postupak u Republici Hrvatskoj s ostavinskim postupkom u Francuskoj na kraju rada.
Abstract (english)
In this paper, the subject of the inheritancee procedure is theoretically and practically processed. In more detail, the notion of hereditary rights, characteristics and assumptions of obtaining an inheritance right will be analysed. The inheritance procedure in general, its principles and jurisdiction to discuss the estate will also be mentioned. Previous actions of the inheritance procedure will be specified and explained as well as the initiation and conduct of the inheritance procedure itself. Near the very end of the work, the legacy debate, its course and implementation will be mentioned and explained. The inheritance procedure in the Republic of Croatia will be compared with the inheritance procedure in France at the end of the work.
