Abstract Polazeći od određenja općeg akta kako ga je definirao Ustavni sud ovoj kontroli podliježu svi općenormativni akti koje donose jedinice lokalne i područne (regionalne) samouprave, pravne osobe koje imaju javnu ovlast i pravne osobe koje obavljaju javnu službu. Kontrola statuta jedinice lokalne i područne (regionalne) samouprave i dalje je u nadležnosti Ustavnog suda, dok međutim kontrola statuta drugih donositelja to nije. Opći akti mogu se donositi u obliku odluka, pravilnika, naredbi, poslovnika, ali u praksi su mogući i drugi nazivi. Nakon donošenja svakog općeg akta predsjednik predstavničkog tijela dužan je u roku od 15 dana od dana njegova donošenja taj akt zajedno sa izvatkom iz zapisnika koji se odnosi na postupak njegova donošenja dostaviti predstojniku ureda državne uprave u županiji. Također, iste akte dužan je bez odgode dostaviti i izvršnom čelniku. Dostava akata omogućuje provođenje nadzora nad njihovom zakonitošću. Uzimajući u obzir činjenicu da opći akti javnopravnih tijela mogu činiti izvore prava, nužno je istaknuti kako je za donošenje općih akata potrebno postojanje ovlaštenja da se njima reguliraju društveni odnosi. Opći akti moraju biti objavljeni na odgovarajući način i dostupni, te sadržajno ne smiju biti protivni sadržaju višeg pravnog akta. Opći akti mogu biti statuti, poslovnici, pravilnici, odluke, smjernice, napuci, akti planiranja, generalne instrukcije, programi rada i sl.
Abstract (english) Starting from the definition of a general act as defined by the Constitutional Court, this control is subject to all general acts adopted by local and regional self-government units, legal persons having public authority and legal entities performing public service. The control of the statute of the units of local and regional self-government remains under the jurisdiction of the Constitutional Court, while the control of the statutes of other donors is not. General acts can be made in the form of decisions, ordinances, orders, rules of procedure, but in practice other titles are possible. Upon the adoption of each general act, the President of the representative body shall, within 15 days from the date of its adoption, submit the act together with the exclusion from the minutes relating to the procedure of its adoption to the head of the state administration office in the county. Also, the same acts shall be forwarded to the Executive Leader without delay. The delivery of the act allows for the supervision of their legality. Considering the fact that general acts of public administrative bodies can be used as a source of law, it is important to point out that for enacting the general acts is needed existence of authorization which regulate social relations. General acts must be declared on corresponding and accessible way. Also, their content is not allowed to oppose to a higher legal act. General acts can be statutes, rules of procedure, decrees, guidelines, instructions, planning acts, general instructions, working programs, etc.
