Abstract
Ugovorni odnos u kojemu jedna strana (davatelj franšize) ustupa uz naknadu pravo iskorištavanja svoj žig, tvrtku i način poslovanja drugoj strani (primatelj franšize) naziva se ugovor o franšizi. Franšiza postoji još od davnih vremena, pojavila se u Kini 200 godina prije Krista, ali svoj standardni oblik koji se danas dobro poznaje dobila je u 20. stoljeću. Tijekom 60-tih godina 20. stoljeća pojavila se potreba za donošenjem zaštitnih zakona vezanih uz franšizu na razini Amerike. Te je tako franšiza dobila oblik franšiznog poslovanja, a tada su osnovani: Kentucky Fried Chicken, McDonald´s i Burger King te se onda ovaj način poslovanja proširio i diljem svijeta. Franšiza ima razne prednosti zbog kojih je lakše započeti posao kao primatelj franšize nego otvoriti vlastiti posao koji nije vezan ovakvim tipom ugovora. U ovom radu napravljena je anketna analiza o stanju McDonald's franšize na tržištu Republike Hrvatske gdje su ispitanici izjasnili svoja mišljenja o kvaliteti, rasprostranjenosti, konzistentnosti i ostalim čimbenicima uspješnosti ove franšize.
Abstract (english)
The contractual relationship in which one party (the franchisor) has the right to exploit its trademark, company and the way of doing business (franchisee) is called a franchise agreement. Franchise has existed since ancient times, in China before 200 BC, but its standard form, which is well-known today, was gained in the 20th century. During the 60s of the 20th century, there was a need for the adoption of US-owned franchise patents. So then the franchise was given the form of a franchise business, and then Kentucky Fried Chicken, McDonald's and Burger King were established, and then this business was expanded all over the world. Franchise has various advantages that make it easier to start a business as a franchisee than to open a business that is not related to this type of contract. In this paper, a survey of McDonald's franchise status on the Croatian market was made, where respondents expressed their opinion on quality, distribution, consistency and other factors of the success of this franchise.
